Affiliate Program Terms & Conditions
These Affiliate Program Terms & Conditions govern participation in the GigAssist365 Affiliate Program. By joining the program, activating an affiliate account, using a referral link or tracking method, or earning commissions through the program, you agree to these Terms.
1. Eligibility and Acceptance
Participation is subject to approval by GigAssist365. GigAssist365 may accept or reject an application in its reasonable discretion.
By participating, you confirm that the information you provide is accurate and that you are legally able to enter into this agreement.
2. Nature of the Affiliate Relationship
Participation in the GigAssist365 Affiliate Program is voluntary and non-exclusive.
Unless GigAssist365 and the affiliate enter into a separate written agreement, participation does not require:
- a minimum number of posts;
- a minimum number of referrals or sales;
- specific posting deadlines;
- exclusivity;
- mandatory content formats;
- content preapproval;
- performance reports;
- sharing of audience analytics or audience data; or
- customer-service responsibilities.
Any sponsored campaign requiring specific content, deliverables, deadlines, usage rights, creative approval, or other obligations must be governed by a separate written agreement.
Affiliates participate as independent contractors and not as employees, agents, franchisees, joint venturers, or legal representatives of GigAssist365.
3. Program Overview
Approved affiliates receive a unique referral link or other authorized tracking method. When an eligible customer reaches GigAssist365 through an affiliate referral and completes a qualifying purchase, the affiliate may earn a commission in accordance with these Terms.
GigAssist365 may introduce temporary bonuses, performance incentives, increased commission rates, or other promotional programs in the future.
4. Qualifying Purchases
A commission is earned only on a qualifying, successfully paid transaction that is properly attributed to the affiliate.
Free Case Assessments, unpaid leads, incomplete checkouts, failed payments, test transactions, fraudulent transactions, duplicate transactions, refunded transactions, successfully charged-back transactions, or transactions otherwise determined to be invalid do not generate payable commissions.
5. Commission Calculation
Unless otherwise stated, commissions are calculated from the qualifying amount actually paid by the customer for an eligible GigAssist365 service.
The current base commission rate is 20%.
- A $49 Appeal Support purchase generates a $9.80 commission.
- An $89 Formal Escalation purchase generates a $17.80 commission.
Taxes, refunds, chargebacks, payment reversals, unauthorized payments, fraud, and other excluded amounts may be removed from the amount used to calculate commission where applicable.
6. Service Upgrades
Formal Escalation may be purchased directly when appropriate or may become the next step after Appeal Support.
If a customer first purchases Appeal Support for $49 and later upgrades that same case to Formal Escalation, the customer pays only the difference between the service levels.
Under the current pricing structure, the customer’s total cost for that case is $89 and the affiliate’s total commission is $17.80.
The affiliate originally attributed to the customer remains attributed to an eligible upgrade of that same case. A separate future case or unrelated purchase is subject to the normal attribution rules then in effect.
7. Attribution and Tracking
Referral tracking is administered through GigAssist365’s designated affiliate technology provider, currently GoAffPro. GoAffPro provides tracking and affiliate-program technology. The affiliate’s commercial relationship is with GigAssist365.
Attribution generally uses a 30-day cookie or comparable authorized tracking mechanism. Tracking may be affected by cookie settings, browser privacy settings, device changes, different browsers, ad blockers, customer actions, deleted cookies, technical issues, or other factors outside GigAssist365’s control.
Where standard tracking successfully records a referral, that attribution will ordinarily determine commission eligibility.
If an affiliate believes that a legitimate referral was not properly attributed because of a technical issue, the affiliate may contact GigAssist365 for review. GigAssist365 may manually correct attribution when reasonable and credible evidence establishes that the transaction originated from the affiliate.
8. Affiliate Account Registration
Affiliates enroll directly through the official GigAssist365 affiliate portal: https://gigassist365.goaffpro.com.
Affiliates are not required to locate GigAssist365 through a general affiliate marketplace.
Affiliates are responsible for protecting their affiliate-account credentials and for providing accurate account and payout information.
9. Payouts
Eligible affiliate commissions are paid weekly on Fridays.
A qualifying customer payment must remain on hold for at least one full week before the corresponding commission becomes eligible for payout. This holding period permits GigAssist365 to review immediate payment fraud, chargebacks, unauthorized transactions, refunds, transaction disputes, and other circumstances that may make a transaction invalid.
The current available payout methods are:
- PayPal;
- bank transfer; and
- Venmo.
The ordinary minimum payout threshold is $10. Affiliates are responsible for providing accurate payout information.
10. Refunds, Chargebacks, Fraud and Reversals
If a transaction is refunded, successfully charged back, reversed, fraudulent, unauthorized, cancelled, or otherwise determined not to be a qualifying purchase, the corresponding commission may be cancelled, withheld, reversed, or deducted from future affiliate earnings as reasonably appropriate.
GigAssist365 will not reverse otherwise valid commissions solely because the customer did not obtain the account outcome they hoped to achieve.
11. Editorial Independence
Affiliates retain editorial control over their independent content.
Nothing in these Terms prohibits an affiliate from:
- expressing truthful criticism;
- expressing a good-faith opinion;
- reporting an accurately documented customer experience;
- declining to recommend GigAssist365;
- declining to create content about GigAssist365; or
- accurately discussing positive or negative experiences with the service.
Affiliates may not knowingly publish false or materially misleading factual claims about GigAssist365, fabricate customer experiences, knowingly misrepresent the service, or falsely claim conduct that did not occur.
Good-faith criticism or truthful reporting does not, by itself, constitute reputational harm or a violation of these Terms.
12. Accurate Promotion and No Outcome Guarantees
Affiliates must describe GigAssist365 accurately. Affiliates may not state or imply that:
- GigAssist365 guarantees activation or reactivation;
- GigAssist365 guarantees removal from a waiting list;
- GigAssist365 guarantees reinstatement, approval, compensation, or any particular platform decision;
- GigAssist365 is affiliated with, endorsed by, or part of a gig platform unless expressly stated;
- GigAssist365 is a law firm or provides legal representation;
- a customer is guaranteed to win an appeal or recover an account; or
- any success rate, result, testimonial, price, promotion, feature, or partnership exists unless it is accurate and currently authorized.
Affiliates may accurately explain that GigAssist365 provides independent case assessment, appeal support, administrative assistance, and formal escalation services as applicable.
13. Affiliate Disclosures
Affiliates must clearly disclose their material connection to GigAssist365 whenever required by applicable advertising, endorsement, consumer-protection, or platform rules. The disclosure must be reasonably clear and visible to the audience.
Examples may include statements such as “Affiliate link” or “I may earn a commission if you purchase through my link.”
Affiliates remain responsible for complying with disclosure requirements applicable to their platform and content.
14. Ordinary Affiliate Content and Preapproval
Ordinary affiliate content does not require GigAssist365 preapproval provided that:
- GigAssist365 is described accurately;
- the affiliate relationship is properly disclosed where required;
- the affiliate does not make prohibited outcome guarantees;
- current prices and services are described accurately; and
- the affiliate does not falsely represent themselves as an employee, agent, attorney, spokesperson, or representative of GigAssist365.
Affiliates may, without prior approval, add properly disclosed affiliate links to existing or future articles, videos, reviews, educational content, walkthroughs, explainers, or other ordinary affiliate content.
GigAssist365 may request correction of a materially inaccurate factual statement about its services, prices, guarantees, or relationship with gig platforms.
15. Affiliate Content and Intellectual Property
Joining the Affiliate Program does not grant GigAssist365 ownership of or an automatic license to an affiliate’s videos, photographs, articles, social-media posts, name, company name, logo, voice, image, likeness, or other independently created content or intellectual property.
GigAssist365 may not reuse, edit, repost, license, advertise with, sublicense, or create derivative promotional works from affiliate content without separate written permission applicable to that content and intended use.
Any paid advertising rights, whitelisting rights, content licensing, creator usage rights, or similar permissions must be separately agreed to in writing.
16. Use of GigAssist365 Brand Assets
GigAssist365 grants approved affiliates a limited, revocable, non-exclusive, non-transferable right to use authorized GigAssist365 names, referral links, images, logos, and promotional materials solely for lawful promotion of GigAssist365 under these Terms.
Affiliates may not materially modify official logos, create confusingly similar marks, falsely imply official ownership, or register domains or social accounts that reasonably appear to be official GigAssist365 properties.
17. Prohibited Promotional Practices
Affiliates may not:
- send unlawful spam or unsolicited bulk communications;
- use deceptive, fraudulent, or false advertising;
- impersonate GigAssist365, its employees, a gig platform, or another person;
- fabricate testimonials or customer results;
- misrepresent prices, discounts, services, or availability;
- make prohibited platform-outcome guarantees;
- use malware, cookie stuffing, forced redirects, hidden frames, unauthorized browser extensions, or manipulative tracking;
- submit fabricated or unauthorized referrals;
- knowingly encourage fraudulent customer claims;
- represent GigAssist365 as having privileged access to gig-platform decision makers when no such relationship exists; or
- engage in unlawful or intentionally deceptive conduct materially harmful to GigAssist365 or its customers.
Truthful criticism, documented customer feedback, and good-faith opinions are governed by Section 11 and are not prohibited merely because they are negative.
18. Paid Advertising and Brand Bidding
Unless GigAssist365 gives prior written permission, affiliates may not bid on or purchase paid-search keywords consisting of the GigAssist365 name, confusingly similar variations, misspellings, GigAssist365 domain names, or other protected GigAssist365 brand terms.
Affiliates may not create advertisements, domains, pages, accounts, or profiles that falsely appear to be official GigAssist365 properties.
19. Self-Referrals
Unless GigAssist365 expressly authorizes otherwise, affiliates may not earn commissions on their own purchases, artificial self-referrals, transactions primarily created to generate commission, or purchases made using accounts or payment methods controlled by the affiliate for the purpose of artificially creating commission.
20. Fraud and Abuse Review
GigAssist365 may investigate unusual referral activity, conversion patterns, repeated customer information, suspicious payment behavior, tracking manipulation, or other credible indications of fraud or abuse.
During a reasonable review, affected commissions may be temporarily held. Commissions connected to fraudulent, manipulated, unauthorized, or prohibited activity may be cancelled.
21. Customer Information and Privacy
Affiliates receive information reasonably necessary to monitor referrals, qualifying transactions, and commissions through the affiliate dashboard.
Participation in the Affiliate Program does not authorize an affiliate to access a referred customer’s case documents, platform notices, account communications, passwords, recovery codes, two-factor authentication codes, Social Security number, payment-card information, or other sensitive case information.
Customers must submit case information directly through GigAssist365’s authorized systems.
Affiliates may not independently collect sensitive customer information on behalf of GigAssist365 unless separately and expressly authorized in writing.
22. Affiliate Account and External Access
Participation in the Affiliate Program does not require an affiliate to give GigAssist365 access to the affiliate’s Google account, YouTube account, Instagram account, TikTok account, social-media administration, channel analytics, browser, computer, mobile device, or other unrelated third-party accounts.
Participation currently occurs through the GigAssist365 affiliate portal.
23. Independent Contractor Relationship
Affiliates are independent contractors. Nothing in these Terms creates an employment relationship, agency relationship, franchise, partnership, joint venture, or legal-representative relationship between GigAssist365 and the affiliate.
Affiliates do not have authority to enter into contracts, make guarantees, incur obligations, or make legally binding commitments on behalf of GigAssist365.
24. Taxes
Affiliates are responsible for determining, reporting, and paying federal, state, local, international, income, self-employment, sales, or other taxes applicable to their affiliate earnings.
GigAssist365 does not withhold ordinary income or self-employment taxes on behalf of independent affiliates unless required by law.
GigAssist365 or its payment providers may request tax documentation or perform information reporting where required by applicable law.
Nothing in this Section transfers or eliminates a tax-reporting obligation that applicable law places directly on GigAssist365, a payment provider, or another responsible payer.
25. Confidential and Non-Public Information
Affiliates may not improperly disclose confidential non-public information provided by GigAssist365, including private customer information, credentials, unreleased business information, internal security information, or other information clearly identified or reasonably understood to be confidential.
This provision does not prohibit truthful reporting or good-faith criticism based on information that is already public or independently known to the affiliate.
26. Program Changes
GigAssist365 may modify future commission rates, payout schedules, qualification requirements, program features, promotional programs, technology providers, or other program terms.
Material changes may be communicated by email, through the affiliate portal, website notice, or another reasonable method.
Material commission or qualification changes apply prospectively and do not retroactively reduce valid commissions already earned under the terms in effect when those commissions were earned.
This does not prevent GigAssist365 from correcting technical errors or invalidating commissions associated with fraud, refunds, chargebacks, duplicate transactions, or transactions that were never eligible.
27. Suspension and Termination
Either GigAssist365 or the affiliate may terminate participation in the Affiliate Program.
GigAssist365 may immediately suspend or terminate participation for fraud, material misrepresentation, spam, tracking manipulation, prohibited advertising, intentional brand impersonation, unlawful activity, or material violation of these Terms.
Termination does not eliminate valid commissions earned before termination.
Valid earned commissions will remain payable subject only to legitimate fraud review, refunds, chargebacks, reversals, or transactions that were otherwise invalid.
If termination occurs while an affiliate has a valid earned balance below the ordinary minimum payout threshold, that balance will not be forfeited solely because it falls below the ordinary threshold and will be included in a final payout once the applicable holding or review period has been satisfied.
28. No Guarantee of Affiliate Earnings
GigAssist365 does not guarantee that participation will result in traffic, referrals, customers, purchases, commissions, income, or any minimum earnings. Results depend on numerous factors outside GigAssist365’s control.
29. Program Technology
Affiliate tracking, dashboards, links, cookies, account functionality, and related services may be provided by third-party technology providers such as GoAffPro.
GigAssist365 does not guarantee uninterrupted operation of third-party systems and may replace or modify affiliate technology when reasonably necessary.
30. Limitation of Liability
To the maximum extent permitted by applicable law, GigAssist365 will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages; lost profits; commissions never validly earned; loss of traffic; lost business opportunities; third-party platform actions; or temporary third-party technology interruptions arising from participation in the program.
Nothing in these Terms eliminates liability that cannot lawfully be excluded.
31. Governing Law
These Affiliate Program Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where applicable law requires otherwise.
32. Electronic Acceptance
Clicking an acceptance checkbox, submitting an affiliate application referencing these Terms, activating an affiliate account, or continuing to participate after being presented with these Terms constitutes electronic acceptance to the extent permitted by applicable law.
33. Entire Agreement and Separate Campaign Agreements
These Terms govern participation in the standard GigAssist365 Affiliate Program.
A separate written agreement may govern sponsored campaigns, commissioned content, special promotions, paid usage rights, enhanced commissions, creator deliverables, or other arrangements.
Where a separately signed written agreement expressly conflicts with these Terms regarding a particular campaign or arrangement, that written agreement controls for that specific matter.
If any provision of these Terms is held unenforceable, the remaining provisions continue to apply to the extent permitted by law.
