These Terms & Conditions govern your use of GigAssist365.com, our Free Case Assessment, customer portal, communications, and any paid assistance services you purchase.
1. Acceptance of Terms
By accessing GigAssist365.com, submitting a Free Case Assessment, creating an account, using the customer portal, purchasing a service, or otherwise using GigAssist365, you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the service.
2. Our Services
GigAssist365 provides independent informational and administrative assistance for gig workers dealing with account-related issues. Depending on the service selected, this may include case review, appeal-letter preparation, procedural guidance, document organization, follow-up assistance, and other case-specific administrative support.
GigAssist365 is not a law firm, does not provide legal representation, and does not act as your attorney. Information provided through the service is for general informational and administrative-assistance purposes and is not legal advice.
3. Free Case Assessment
The Free Case Assessment is intended to help you better understand your reported account issue and possible next steps. It is based on the information you provide and information available to GigAssist365 at the time of review.
The assessment may identify missing information, recommend do-it-yourself steps, recommend no paid service, or identify an optional paid GigAssist365 service. A service recommendation does not guarantee a favorable result.
4. Paid Services
Paid services are limited to the scope described on the applicable service page, checkout page, order confirmation, or customer portal. You are purchasing the administrative work and deliverables described for that service, not a guaranteed decision from a gig platform.
5. Your Responsibilities
You agree to provide accurate, complete, and truthful information and to respond reasonably promptly when GigAssist365 requests information or documents needed to perform the purchased service. You remain responsible for platform deadlines and instructions.
Do not provide passwords, full Social Security numbers, banking credentials, full payment-card information, or other unnecessary highly sensitive information.
6. No Guarantee of Outcome
GigAssist365 cannot guarantee that a gig platform will reactivate, reinstate, restore, approve, compensate, or otherwise rule in your favor. We do not control platform policies, reviews, appeal decisions, investigations, response times, or enforcement actions.
7. AI-Assisted Processing
GigAssist365 may use artificial intelligence and automated tools to help review submitted information, organize case details, research publicly available information, generate internal drafts, and prepare customer-facing assessment content. Automated systems can make mistakes, and important information or documents should be reviewed before reliance or submission.
8. Payments
Prices are displayed before purchase. Payments may be processed by third-party processors such as Stripe, whose own terms and privacy practices may apply. You authorize the amount shown at checkout and are responsible for providing accurate billing information.
9. Refund Policy — All Sales Final
Because GigAssist365 provides customized administrative services, all purchases are final and non-refundable once payment is completed, except where a refund is required by applicable law or where GigAssist365 fails to deliver the purchased service within the specific delivery timeframe promised to the customer for reasons solely within GigAssist365’s control.
A delay is not considered a failure to deliver when completion depends on information, documents, clarification, responses, approvals, or other action required from the customer or a third party. Any stated delivery timeframe is paused while GigAssist365 is waiting for required information or action and resumes once the required information or action is received.
Refunds are not issued because of the outcome of a customer’s case, including denial of an appeal, failure to reactivate or reinstate an account, delayed responses or decisions by a gig platform, changes in platform policies, or any other decision outside GigAssist365’s control.
If GigAssist365 determines that it cannot provide the purchased service, or fails to deliver it within the applicable promised timeframe for reasons solely within GigAssist365’s control, the customer may be eligible for a refund of the amount paid for the undelivered service.
10. Delivery Timeframes and Customer Holds
Any delivery timeframe communicated by GigAssist365 assumes that all information and documents reasonably required to perform the service have been received. If additional information or documents are required, the delivery clock pauses until the requested material is received. Time spent waiting on a gig platform or other third party is also outside GigAssist365’s control and does not constitute late delivery by GigAssist365.
11. Service Delivery vs. Platform Outcome
GigAssist365 fulfills the purchased service by performing and delivering the administrative work described in the selected package. Delivery of that work is separate from the eventual decision, response time, or action of the gig platform.
12. Communications
By providing your email address or phone number, you authorize GigAssist365 to send service-related communications about your assessment, case status, documents, payments, missing information, and support. Marketing communications may be declined separately where applicable.
13. Documents & Uploads
You represent that you have the right to submit materials you upload and permit GigAssist365 to use them as reasonably necessary to provide, secure, document, improve, or support the requested service.
14. Prohibited Use
You may not use GigAssist365 to impersonate another person, create false evidence, submit fraudulent appeals, facilitate account sharing, evade platform security, violate law, interfere with our systems, or misuse another person’s information.
15. Disclaimer of Warranties
To the maximum extent permitted by law, GigAssist365 is provided on an “as is” and “as available” basis. We do not warrant uninterrupted, error-free, complete, or universally suitable service. Platform policies and procedures can change without notice.
16. Limitation of Liability
To the maximum extent permitted by applicable law, GigAssist365 will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages; lost income; lost gig opportunities; lost profits; loss of data; or losses resulting from a gig platform’s decision or delay. GigAssist365’s total liability arising from a paid service will not exceed the amount paid for the specific service giving rise to the claim.
17. Suspension or Termination
We may suspend or terminate access for fraud, abuse, unlawful activity, security risk, misuse, violation of these Terms, or nonpayment. We may also decline a case when the requested service is not suitable.
18. Changes to These Terms
We may update these Terms from time to time. The Last Updated date will be revised when changes are posted. Continued use after an update becomes effective constitutes acceptance to the extent permitted by law.
19. Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
20. Electronic Acceptance
When GigAssist365 presents an unchecked checkbox requiring you to agree to the Terms & Conditions, Refund Policy, and Privacy Policy before submitting a form or completing a purchase, selecting that checkbox and proceeding constitutes your electronic acceptance of those policies. GigAssist365 may retain records of the date, time, account, transaction, or version associated with that acceptance.
